Affiliatant

Terms of service

The terms on which Havenswift Hosting Ltd provides Affiliatant. In plain words, with the parts that actually matter said first.

1. Who we are

Affiliatant is operated by Havenswift Hosting Ltd, 71-75 Shelton Street, London WC2H 9JQ, United Kingdom. "We" and "us" mean that company. "You" means the business that holds the account.

2. What the service does, and what it does not

Affiliatant records affiliate referrals, decides which partner a sale should be credited to, calculates commission from the rules you set, produces payout instructions and the associated tax documents.

Affiliatant does not hold, receive, transmit or pay out money on your behalf, and it never will. Payments to your partners are made by you, from accounts you control. We are not a payment service, we are not an agent for collection, and we do not act as an intermediary for funds. Any figure we produce is a calculation for you to act on, not an instruction we carry out.

3. Your account

You are responsible for what is done with your account and your API keys. Keep them secret; rotate them in the console if you think they have leaked. You must not use the service to track people in ways your own privacy notice does not permit.

4. Bands, billing and stopping

The free band is free with no time limit. Paid bands are billed in advance, monthly or annually, by card through Stripe. The price you see is the price you pay: there is no setup fee, no minimum term, no notice period and no percentage of your sales or your payouts.

Exceeding your band's monthly ceiling does not stop the service and does not generate an extra charge. We will tell you in the console and ask you to move up.

You may cancel at any time, from the billing portal. Your account then returns to the free band at the end of the period you have paid for. Nothing is deleted, your tracking links keep working and your partners keep their accounts. We do not refund part months.

We may change prices with at least 30 days' notice by email. A price change never applies to a period you have already paid for.

5. Your data

Your data is yours. Every report exports as CSV and the API will return anything the console shows. If you leave, ask and we will give you a copy.

For personal data we process on your behalf, you are the controller and we are the processor. The privacy notice sets out what is held, for how long, and who the sub-processors are.

6. Availability

We aim for the service to be available continuously and we do not promise that it will be. The tracking and conversion endpoints are the parts that matter most, and the integrations we publish all queue locally and retry, so a period of unavailability at our end should cost you recorded conversions rather than lost ones.

We will give notice of planned maintenance that we expect to be disruptive.

7. Acceptable use

Do not use Affiliatant for anything unlawful, to send unsolicited bulk email, to track people who have not been given the opportunity to refuse non-essential tracking, or to operate a programme that is itself a fraud on the partners taking part in it. We may suspend an account that is doing any of those, and we will tell you why.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability to you in any twelve month period is limited to the amount you paid us in that period, and we are not liable for loss of profit, loss of business, or losses arising from a decision you took on the basis of a figure the service produced. Affiliatant is a tool for calculating commission; the commercial decisions remain yours.

9. Ending it

You can stop at any time. We may end an account with 30 days' notice, or immediately if it is being used in breach of section 7. If we end your account other than for breach, we will refund the unused part of anything paid in advance.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

11. Changes

We may update these terms. If a change materially affects you we will email the account administrator at least 30 days before it takes effect.
